These Terms and Conditions (“Terms”) govern the use of services provided by KRYS Remodeling (“we,” “us,” “our”) to our clients (“Client” or “you”) for home remodeling and renovation services. By engaging in our services, you agree to abide by these Terms. Please read them carefully before proceeding with any transaction or service engagement. • Agreement: By hiring KRYS Remodeling, you enter into a binding agreement to abide by these Terms. This agreement applies to all services provided by KRYS Remodeling.
• Scope of Services: The services offered by KRYS Remodeling include kitchen remodeling, bathroom renovations, basement finishing, custom cabinetry, electrical and plumbing services, drywall, and painting. Specific services will be outlined in a project proposal and discussed prior to commencement.
• Service Area: We provide remodeling and renovation services in the southwest, north, and northwest suburbs of Chicago. We are not responsible for projects outside of this designated area unless otherwise agreed upon in writing.
• Estimates: KRYS Remodeling provides free initial consultations to assess the scope of work. Upon review, we will present you with an estimate for the services to be rendered. This estimate is non-binding unless explicitly stated in the agreement.
• Final Pricing: The final price for services will depend on the scope of work, labor, materials, and other related costs. You will receive a final proposal and contract detailing the full costs associated with the project. Once approved and signed by you, the agreement becomes legally binding.
• Payment: Payment terms will be specified in the contract. Typically, payments are broken down into installments based on project milestones. Payment is due upon completion of each milestone as outlined in the contract. Final payment is due upon project completion. Late payments may incur interest charges at a rate of 1.5% per month.
• Change Orders: Any changes made to the original project scope after the contract has been signed may result in additional costs. You will be notified of any changes, and a change order agreement will need to be signed.
• Site Access: The Client is responsible for ensuring that we have access to the site during agreed-upon work hours to perform services. Failure to provide access may result in delays and additional costs.
• Permit and Licensing: If required, the Client is responsible for obtaining any necessary permits for the project. KRYS Remodeling can assist with obtaining permits, but it is the Client’s responsibility to ensure compliance with all local regulations.
• Preparation: The Client must prepare the area for remodeling by removing any furniture, appliances, or personal items. KRYS Remodeling will not be held responsible for damage to these items if they are not removed before work begins.
• Workmanship Warranty: KRYS Remodeling offers a warranty for workmanship for a period of one year from the date of completion. This warranty covers defects caused by poor workmanship or materials we provide. It does not cover damages caused by normal wear and tear, misuse, or external factors beyond our control (e.g., water damage, accidents, or natural disasters).
• Manufacturer Warranties: Materials and products supplied by KRYS Remodeling (e.g., cabinetry, appliances, fixtures) may be covered by manufacturer warranties. KRYS Remodeling will assist you in filing warranty claims with the manufacturer, but the warranty is solely between you and the manufacturer.
• Delays: We strive to complete projects on time, but delays may occur due to unforeseen circumstances such as weather conditions, supply chain disruptions, or other factors beyond our control. We will notify you promptly if there are any significant delays.
• Extensions: If the project is delayed by factors outside of KRYS Remodeling’s control, such as client requests for additional work or changes, we may extend the timeline. The Client will be informed of any new estimated completion dates.
• Termination by Client: The Client may terminate the agreement at any time, but termination must be done in writing. If the Client terminates the agreement after work has started, the Client agrees to pay for all work completed up to the termination date, including any materials already purchased.
• Termination by KRYS Remodeling: KRYS Remodeling may terminate the agreement at any time if the Client fails to make payments as agreed, breaches the terms of the contract, or refuses to provide necessary access or cooperation for project completion.
• Refunds: In the event of termination, the Client will not be entitled to a refund for any work completed. KRYS Remodeling reserves the right to retain payment for any work performed or materials purchased.
• Insurance Coverage: KRYS Remodeling is fully insured and bonded. Our insurance covers workers’ compensation, general liability, and property damage during the course of the project. However, the Client is responsible for their own insurance coverage for personal belongings or property during the remodeling process.
• Liability: KRYS Remodeling is not liable for damages or injuries that occur on the Client’s property outside the scope of the work provided nor for any damages caused by third-party contractors or suppliers not engaged by us.
• Mediation and Arbitration: In the event of a dispute, KRYS Remodeling and the Client agree to resolve the matter through mediation or arbitration rather than through litigation. Mediation will be attempted first, and if unresolved, arbitration will take place in accordance with the laws of the State of Illinois.
• Legal Fees: If a legal dispute arises and is not resolved through mediation or arbitration, the prevailing party will be entitled to recover reasonable legal fees, including attorney’s fees.
• Confidentiality: KRYS Remodeling respects the privacy of our clients. Any personal information provided by the Client, including contact information, payment details, or project preferences, will be kept confidential and will only be used for the purposes of fulfilling the contract and providing services.
• Data Protection: We ensure that all client data is securely stored and handled in compliance with applicable privacy laws. However, KRYS Remodeling cannot guarantee the security of information transmitted over the Internet, and the Client accepts the inherent risks of electronic communication.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Illinois. Any disputes or claims arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Cook County, Illinois.
KRYS Remodeling reserves the right to update or modify these Terms and Conditions at any time. Any changes will be communicated to the Client in writing or via the company’s website. The updated Terms will be effective upon posting.
